Terms and conditions
1. Introduction
Welcome to the Makedo 15th Anniversary Design Competition ("Competition"). By participating in this Competition, you ("Participant") agree to abide by the following terms and conditions ("Terms"). These Terms govern your participation in the Competition and form a binding agreement between you and the Promoter. The Competition aims to celebrate creativity and innovation using Makedo tools, and it is open to eligible participants worldwide. Please read these Terms carefully to ensure you understand and comply with all requirements. If you have any questions, feel free to contact us at hello@make.do.
For the purpose of these Terms, the Promoter is Makedo Pty Ltd of 4 Paterson Street, Abbotsford, VIC 3067, Australia (ABN: 97 138 360 335) (“Promoter”).
2. Eligibility
The Competition is open to legal residents of countries where such competitions are legally permitted and not prohibited. Participants must comply with local laws and regulations applicable to competitions and prize awards in their country of residence.
Participants must form teams consisting of at least one adult (18 years or older) and one child (under 18 years old). Each team represents a single eligible participant, and multiple entries from the same team are not allowed.
The Promoter reserves the right to verify the eligibility of participants and may require additional documentation or information as necessary to confirm compliance with these Terms. Any participant who does not meet the eligibility requirements or who provides false or misleading information may be disqualified from the Competition.
If a participant fails to provide the required verification documents within 7 days of being requested, the Promoter reserves the right to disqualify the participant and select an alternate winner from the remaining eligible entries.
3. Entry Requirements
All entries must be original works created using Makedo tools.
Participants must document their creation process and submit their entry via the provided form on https://www.make.do/pages/15th-birthday.
Participants are limited to one entry.
Entries must be submitted by the deadline, which is September 30, 2024, 23:59 AEST.
4. Submission Guidelines
Entries must include a title, brief description, list of materials used, photos or videos of the creation, and a written story or documentation. By submitting an entry, participants grant the Promoter a non-exclusive, worldwide, royalty-free licence to use, reproduce, modify, publish, and display the submission for promotional and marketing purposes, both in connection with the Competition and outside of it.
Upon submission, participants will receive a confirmation email acknowledging receipt of their entry. It is the participant’s responsibility to ensure that the submission is complete and that they have received this confirmation. If a confirmation email is not received within 48 hours of submission, participants should contact the Promoter at hello@make.do to verify that their entry has been received. The Promoter is not responsible for any technical issues, including those caused by the participant’s equipment or network, that may result in incomplete, delayed, or undelivered submissions. Participants are encouraged to keep a copy of their submission and confirmation email for their records.
Entries that do not meet the submission guidelines will be disqualified. The Promoter is not responsible for any incomplete or incorrect submissions. Participants are encouraged to review their entries carefully before submission to ensure compliance with all guidelines. If a participant realises that their submission is incomplete or incorrect, they may contact the Promoter at hello@make.do within 24 hours of submission to rectify the issue, provided the correction does not involve a material change to the submission and the submission deadline has not passed.
5. Judging and Prizes
Entries will be evaluated by a panel of three designers employed by the Promoter. The judging will be based on the following criteria:
- Creativity: The originality and inventiveness demonstrated in the entry.
- Innovation: The uniqueness and novelty of the approach and solutions used.
- Use of Makedo Tools: The effective and creative application of Makedo tools in the creation.
- Storytelling: The ability to convey a compelling narrative or concept through the submission.
The panel will review all entries and select winners based on the overall scores assigned to each criterion. The decisions of the judging panel are final and binding with the scoring system used by the panel will be kept confidential.
Prizes include:
- 1 x US $1,500.00 for the winner,
- 1 x US $500.00 for the runner-up, and
- 10 x Discover Kits for honourable mentions.
Prizes are non-transferable and cannot be exchanged for cash. Winners will be selected and notified by October 14, 2024 23:59 AEST. Winners will be contacted privately via the email address provided in their submission. Additionally, winners' names and details about their winning entries may be announced on the Promoter’s social media platforms.
Cash prizes will be transferred via PayPal. Discover Kits will be sent to participants’ shipping addresses, collected in the submission form, and shipped at no extra cost. Exchanges of Discover Kits will only be granted if the kits are deemed faulty.
6. Prize Taxes
Winners are responsible for any taxes, duties, fees, or charges associated with the receipt and use of their prize, including but not limited to any transaction or processing fees. The Promoter will not be responsible for any tax obligations incurred by the winner. Winners may be required to provide additional information or documentation to comply with tax regulations. By accepting a prize, winners agree to indemnify the Promoter against any claims or liabilities arising from the non-payment of taxes or other obligations related to the prize.
7. Currency and Payment
Prizes will be awarded in USD via PayPal. If a winner is unable to accept the prize in USD due to restrictions, the Promoter reserves the right to offer an alternative payment method or an equivalent prize value in another currency, at the Promoter’s sole discretion.
The equivalent value will be determined based on the exchange rate at the time of the prize award, as decided by the Promoter. The winner must notify the Promoter of any restrictions on currency acceptance within 7 days of being notified of their win. If the Promoter is unable to accommodate the winner’s restrictions or if no notification is received within this timeframe, the Promoter reserves the right to offer the prize in USD or to select an alternate winner.
If the PayPal payment fails, the Promoter will attempt to contact the winner for an alternative method of payment. If no successful payment method is provided within 7 days of notification, the Promoter reserves the right to forfeit the prize and select an alternate winner.
If the winner cannot accept the prize in any form offered, the Promoter reserves the right to award the prize to an alternate winner and may make necessary adjustments to the prize value.
8. The Competition is a skill-based contest.
All entries will be evaluated based on creativity, innovation, the use of Makedo tools, and storytelling. No element of chance is involved in the judging process. Participants are required to demonstrate their skills and creativity through their submissions. By entering, participants acknowledge and agree that the Competition is not a lottery, sweepstakes, or game of chance.
9. Intellectual Property
Participants retain ownership of their submissions. By entering the Competition, participants grant the Promoter a non-exclusive, worldwide, royalty-free licence to use, reproduce, modify, publish, and display the submissions. This licence includes, but is not limited to, use in connection with the Competition, as well as for promotional and marketing purposes both related to and outside the scope of the Competition.
The scope of this licence permits the Promoter to use the submissions on its website, social media platforms, and other marketing materials, as well as in any other manner deemed appropriate by the Promoter for promotional purposes. Participants acknowledge that such use may include showcasing the submissions beyond the immediate context of the Competition.
Participants agree that the Promoter will not be liable for any claims of intellectual property infringement arising from the use of the submissions within the scope of this licence. Participants are responsible for ensuring that their submissions do not infringe upon any third-party intellectual property rights.
10. Liability and Indemnification
The Promoter is not responsible for any damage or loss resulting from participation in the Competition. To the maximum extent permitted by law, the Promoter’s liability for any claims arising out of or in connection with the Competition, including but not limited to any liability for negligence, is limited to the value of the prize won. Participants agree to indemnify and hold the Promoter harmless from any claims, damages, or expenses arising from their participation or entry.
The Promoter is not liable for any indirect, incidental, special, or consequential damages, or any loss of profits, arising from participation in the Competition. This limitation of liability applies regardless of the form of action, whether in contract, tort, or otherwise.
The Competition is not sponsored, endorsed, administered by, or associated with Facebook or Instagram in any way. The Promoter and Participants release Facebook and Instagram from any liability associated with the Competition.
11. Disqualification
The Promoter reserves the right to disqualify any participant who fails to comply with these Terms or engages in fraudulent, unethical, or improper behaviour that jeopardises the fair and proper conduct of this promotion. The Promoter will provide written notice to the disqualified participant and reserves the right to seek legal remedies for any damages or losses incurred due to such behaviour. This includes, but is not limited to, submission of false or misleading information, plagiarism, or any form of cheating.
The Promoter’s legal rights to recover damages or other compensation from such a disqualified entrant are reserved.
Disqualified participants forfeit any and all rights to receive prizes. The Promoter may select an alternate winner if a participant is disqualified. The decision to disqualify a participant and select an alternate winner is at the Promoter’s sole discretion and is final.
12. Alternative Winners
If a winner is disqualified or unable to accept the prize, the Promoter will select an alternate winner from the remaining eligible entries. The decision to select an alternate winner is final and binding. The Promoter will notify the alternate winner within 7 days of disqualification or forfeiture in accordance with the notification process outlined in these Terms.
13. Privacy
Personal information collected during the Competition will be used solely for the purposes of administering the Competition and will not be shared with third parties, except as required by law. By entering, participants consent to the collection and use of their personal information as described in the Promoter’s Privacy Policy.
14. Governing Law
Any disputes or claims arising out of or relating to these Terms or the Competition shall be resolved in accordance with the laws of Victoria, Australia. Participants agree to submit to the jurisdiction of the courts of Victoria, Australia, for the resolution of any such disputes.
15. Modifications & Notification of Changes
The Promoter reserves the right to modify these Terms without prior notice. Any changes will be effective immediately upon posting on the Promoter's website. Participants will be notified of significant changes to the Terms via the contact information provided during submission within 7 days of the changes. It is the responsibility of participants to check the Promoter’s website regularly for updates. Continued participation in the Competition after any modification constitutes acceptance of the updated Terms.
16. Force Majeure and IT Interruptions
The Promoter shall not be liable for any failure to perform its obligations under these Terms if such failure is due to circumstances beyond its reasonable control. This includes, but is not limited to, acts of God, natural disasters, war, terrorism, civil disturbances, strikes, labour disputes, significant IT interruptions (such as server outages, hacking, or service provider failures), or any other event or circumstance that the Promoter could not reasonably anticipate or prevent.
In the event of a force majeure occurrence or significant IT interruption affecting the Competition, the Promoter reserves the right to cancel, terminate, modify, or suspend the Competition, or extend the submission deadline as necessary, at its sole discretion. Participants will be notified of any such changes or extensions as soon as reasonably possible. The Promoter will not be liable for any damages or losses resulting from such changes, cancellations, or interruptions.
